In his suit papers the businessman says he is bound to suffer irreparable loss if the soldiers continue holding the sugar or destroy it. Through his lawyer Evans Ondieki, Abdirahman says the move to detain the sugar is malicious and in blatant disregard of the law. In an affidavit filed in support of the application the businessman, who resides in Dobley, Somalia, says his four lorries strayed into Kenya on March 28. The drivers and their turn-boys were arrested by KDF and detained at Liboi camp. They were later charged in court, fined and deported to Somalia. But the KDF did not release the bags of sugar and he fears the soldiers might destroy the sugar. He says the illegal entry into Kenya was caused by the ongoing war and was not intentional.
