CJ: Court to exercise fairness in poll petition

Chief Justice Dr. Willy Mutunga Monday assured Kenyans that the Supreme Court will handle the presidential election petition in a fair manner.

Speaking as he received a copy of the presidential results of the just concluded election from the Independent Electoral and Boundaries Commission chair Issak Hassan, the Chief Justice also said six Supreme Court judges will handle the petition.

The petition was filed by the CORD coalition challenging the win of Uhuru Kenyatta in last week's election.

Cord's legal team is led by renowned lawyer George Oraro with cabinet ministers Mutula Kilonzo, James Orengo and Ababu Namwamba and former AG Amos Wako being part of the legal team.

The case is billed to be a major test on the independence of the Supreme Court. Despite the magnitude of the case, Prime Minister Raila Odinga has expressed confidence that the Kenyan judiciary has reformed and that justice will prevail.

Focus now shifts to the six judge bench in the highest court on land, where the suit is expected to rely on Cord's assertion that the equipment that IEBC had deployed for the election had not worked as planned.

If CORD wins the case, then the president elect will not be sworn in on 26th of March, and a fresh election shall be held within sixty days.

Nevertheless, preparations for the inauguration ceremony set to be held in Kasarani are still ongoing.
